These terms and conditions confirm the legal terms on which we will sell the products listed on our website.
These terms apply to any contract between us for the sale of products. Please read them carefully and make sure you understand them before you place your order.
You must be at least 18 years of age to use this website. By using this website and agreeing to these terms and conditions, you represent and warrant that you are at least 18 years of age.
Any variation to these terms and conditions shall be inapplicable unless agreed in writing by Fencing Fife.
Nothing in these terms and conditions shall prejudice any condition or warranty, express or implied, or any legal remedy to which Fencing Fife may be entitled in relation to the goods and services, by virtue of any statute, law or regulation.
Nothing in these terms and conditions shall affect the customer’s statutory rights as a Consumer.
How the contract is formed between us and you (the customer)
Our order process allows you to check and amend any errors before placing your order with us. Please take time to read and check your order prior to checkout. After you place your order, we will send you an order acknowledgement email. However this does not mean that your order has been accepted by us. Unless we have contacted you to confirm that we are unable to accept your order, our acceptance of your order will occur automatically on the day prior to your delivery. The contract between us will only be formed at this time. We reserve the right to reject any order for any reason and no order will be accepted until payment is received in full for all products and any related delivery charges.
All orders are subject to stock availability. If we are unable to supply any of the products that you have ordered we will inform you as soon as possible. In the event that an out of stock product is part of your order and we cannot contact you, we will send the other products you have ordered, refunding the purchase price of any unavailable product where payment has already been made.
The Order
The proposal attached to these terms and conditions shall remain valid for a period of 30 days.
The customer shall be deemed to have accepted the proposal by placing an order with Fencing Fife within the period specified in the clause above.
All orders for goods and services shall be deemed to be acceptance of the proposal pursuant to these terms and conditions.
Goods, Pricing & Availability
Efforts have been made to ensure descriptions and imagery of goods available are representations of the actual goods. However, please note:

It may be your responsibility to select the size of goods that you wish to purchase.
We cannot guarantee the availability of stock.
We try to ensure that any prices that may be displayed on site are correct at the time. However, we reserve the right to alter prices or remove special offers where necessary.
Pricing is checked by when your order is processed. Please note the following in the unlikely event that we have shown incorrect pricing information, please note the following:
We will contact you in writing before proceeding with your order to inform you of the mistake and to ask you how you wish to proceed. We will give you the option to purchase the goods at the correct price or to cancel your order (or the affected part thereof). We will not proceed with processing your order until you respond. If we do not receive a response from you within 7 days, we will treat your order as cancelled and notify you of the same in writing.
In the event that the price of goods you have ordered changes between your order being placed and us processing that order and taking payment, you will be charged the price shown on our site at the time of placing your order.

All quoted delivery dates are subject to change. Although we will try our best to meet the quoted delivery date we will not be responsible if we are unable to do so. We will let you know if we cannot deliver your products on the quoted day and arrange an alternative day.
We recommend that you do not book a tradesperson until your order has been delivered and checked by you. We cannot be held responsible for any third-party costs or charges which you may incur due to non-delivery of an order, or orders that have not been checked on delivery.
The date of delivery specified by Fencing Fife is an estimate only. Time for delivery shall not be of the essence of the contract.
All risk in the goods shall pass to the customer upon delivery.
Cancellations and Refunds for Goods
Where the goods are faulty or do not comply with any of the contract, the customer must notify Fencing Fife within 7 days of delivery. Once Fencing Fife has confirmed the goods are faulty or do not comply with any of the contract the customer shall be entitled to replacement goods or a full refund.
The customer may cancel an order by notifying Fencing Fife in writing (an email is an acceptable form of writing) at the address above within 14 days of placing an order and any deposit paid will be refunded in full.
If the customer fails to cancel the order within the time specified in the clause above, any deposit paid may not be returnable.
If the goods have been dispatched to the customer then it will not be possible to cancel the contract.
Fencing Fife reserves the right to terminate the services without notice or refund if any of these terms have been breached or if it is our belief that the services are being used with fraudulent or criminal intent.
Guarantees
The goods are provided with a manufacturer’s guarantee. Please get in touch to understand more.
The manufacturer’s guarantee exists in addition to your legal rights as a consumer (that the goods match their description, that they are of satisfactory quality and that they are fit for purpose). More information on your rights as a consumer can be obtained from your local Citizens’ Advice Bureau or Trading Standards Office.
Intellectual Property and acceptable use
All content included on the website is the property of Fencing Fife Ltd, our affiliates or other relevant third parties. In these terms and conditions, content means any text, graphics, images, audio, video, software, data compilations, page layout, underlying code and software and any other form of information capable of being stored in a computer that appears on or forms part of this website, including any such content uploaded by users. By continuing to use the website you acknowledge that such content is protected by copyright, trademarks, database rights and other intellectual property rights. Nothing on this site shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark, logo or service mark displayed on the site without the owners prior written permission.

The cardholder shall remain responsible for notifying their issuing bank with any changes in details or fraudulent/not normal activities on their account.
Fencing Fife LTD takes no responsibility regarding any fraudulent activity on any customer's cards/accounts used on this website.
We have taken all necessary steps regarding upholding PCI DSS compliance and remain objective in the case of cardholders bearing their own responsibility regarding jurisdiction laws.
This website, any content contained herein and any contract brought into being as a result of use of this website, are governed by and construed in accordance with Scottish Law.
Limitation of liability
Nothing in these terms and conditions will: (a) limit or exclude our or your liability for death or personal injury resulting from our or your negligence, as applicable; (b) limit or exclude our misrepresentation; or (c) limit or exclude any way of our or your liabilities in any way that is not permitted under applicable law.
We will not be liable to you in respect of any losses arising out of events beyond our reasonable control.
